    BY SUBMITTING AN APPLICATION TO JOIN OR BY PARTICIPATING IN THE PROGRAM, YOU ARE CONFIRMING THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.

    ELIGIBILITY TO PARTICIPATE IN THE PROGRAM

    To participate in the Program, you must be a legal resident of the fifty (50) United States and at least eighteen (18) years of age or older (or the age of majority, whichever is greater) in your state of legal residence. Employees of tomtoc and/or any of its subsidiaries, affiliates or related companies are not eligible to participate.

    Concerning Payments:
        - Payments on eligible conversions will be sent to the email address used to register for the Affiliate Program. If another email address is to be used for payment, please contact us with the correct information. 
        - Affiliates will not be eligible for commissions on personal orders.
        - Affiliates residing outside of the US will be paid via PayPal and their payments will be converted by PayPal into their local currency. 

    Concerning terms & policy:     
        - Affiliates may not create social media pages/websites containing "tomtoc", or any variation thereof.
        - Affiliates also agree to not disclose any discount codes created by tomtoc if they are potentially not for public access and intended for promotional purposes only. 
        - Affiliates may not, under any circumstances, claim to be representatives of or employees of tomtoc. 
        - Affiliates must obtain expressed, written consent to use tomtoc's logo on any creative material used to promote their affiliate link. 
    Violations of the aforementioned policies will result in an immediate deactivation of the affiliate account without payment of existing eligible conversions.

    Contact Details: Name, email, and social media/website handles.
    Payment Info: Your PayPal or bank details for commission payouts.
    Tracking Data: We use cookies to track your referrals. Our tracking cookies remain active for 90 days.

    We use your information specifically to:

    * Verify and manage your affiliate account.
    * Track successful referrals and calculate commissions.
    * Communicate program updates and promotional news.
    * Prevent fraudulent activities and "self-referrals."

    4. Third-Party Sharing

    We do not sell your data. We share your information only with our service providers, **Refersion** and **Shopify**, to facilitate tracking, reporting, and payments. Your data may be processed in the United States.

    5. Your Compliance Obligations

    To protect our brand and remain compliant with the law (FTC):

    Disclosure: You must clearly state that you receive a commission when posting your affiliate link.
    Ethics: You must not use spam, deceptive advertising, or violate the privacy of your audience.

    You may request to view, update, or delete your personal data at any time by contacting us. We retain your information as long as your account is active or for tax record purposes.
